1. Introduction

Welcome to Myti Meats. These Terms and Conditions (together with the documents expressly referred to in them) provide information about us and the legal terms and conditions (“Terms”) on which we sell any of the products (“Products”) listed on our website www.mytimeats.com (“our site”) to you.

These Terms will apply to any contract between us for the sale of Products to you (“Contract”). Please read these terms carefully and ensure you understand them before ordering any products from our site. By ordering our products, you agree to be bound by these Terms and the other documents expressly referred to in them.

2. Online Store Terms

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

3. Our Products

3.1 The images of the products on our site are for illustrative and representation purposes only. Although we have made every effort to display the meat accurately, we cannot guarantee that your computer’s display of the colours accurately reflects the colour of the products. Your products may
vary slightly from those images.

3.2 Although we have made every effort to be as accurate as possible, because our products are cut fresh to order, all sizes, weights, capacities, dimensions, and measurements indicated on our site have a 5% tolerance.

3.3 The packaging of the products may vary from that shown in images on our site.

3.4 All products shown on our site are subject to availability.

3.5 Under certain circumstances, we reserve the right to substitute certain products which may form part of your order.

3.6 Our site contains a number of Products. Despite our reasonable efforts, some of the Products on our site may be incorrectly priced. If we discover an error in the price of the Products you have ordered, we will inform you of this error and give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing, we are not obliged to provide the Products to you at the incorrect (lower) price.

4. Becoming a Customer

To place an order with us, you must be over 18 years of age, require delivery in our delivery area, and have a credit or debit card acceptable to us in your name.

By providing feedback on us or any of our products, you grant us permission to reuse it for marketing or publicity purposes on our social media channels and other marketing platforms.

Complaints must be raised within 12 hours of receiving the product, and we require photographic evidence to substantiate any claim. Complaints should be sent via email to hello@mytimeats.com. We do not respond to complaints made through social media platforms like Facebook or Instagram.

5. Delivery

  • Delivery is only available to a single specified address per order.
  • Orders cannot be split for delivery to multiple locations.
  • Upon delivery, the customer must immediately inspect and verify the order.
  • Once the goods are accepted upon delivery, we will not accept returns due to health and safety regulations.

6. Returns and Cancellations

  • Orders can be cancelled by either party for any reason prior to acceptance or rejection of the quotation.
  • Once meat products have been unpacked or opened, they cannot be returned.
  • Other than by prior agreement, returns will only be accepted if the goods are proven to be
    defective, and we may carry out an inspection to verify any claims.
  • The risk in the goods passes to the customer upon completion of delivery

7. Privacy Policy – Data Protection

  • When providing goods, we may access, transfer, store, or process personal data of the customer.
  • Both parties agree that:
    1. The customer (Buyer) shall be the ‘Data Controller’.
    2. Myti Meats (Seller) shall be the ‘Data Processor’ as defined under the General Data Protection Regulation (GDPR).
  • We shall only process personal data to the extent required to provide the goods and services or as agreed with the customer.
  • Personal data will not be retained longer than necessary for the purposes of processing.
  • We will not process personal data for our own or third-party purposes.
  • Disclosure of personal data to third parties is restricted to employees, directors, agents, subcontractors, or advisors on a strict “need to know” basis and under similar confidentiality obligations.
  • Myti Meats will implement and maintain technical and organisational measures to protect the personal data processed on behalf of the customer.

8. Indemnification

You agree to indemnify, defend, and hold harmless Myti Meats and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Zimbabwe.
